Terms and Conditions for GlobCall

Welcome to GlobCall! By using our service, you're agreeing to these terms. If you do not agree to these terms, you must immediately cease all use of our services.
1. Overview
GlobCall is an international calling service that lets you make voice calls worldwide through your web browser or mobile device. GlobCall acts strictly as a service provider and platform operator, and does not control, direct, or authorize the specific communications initiated by its users.
2. Accounts
You must be at least 18 years old to use GlobCall and provide accurate information when signing up. You're responsible for keeping your account credentials secure and for all activity under your account.
3. Service Usage and Strict Prohibitions
Please use GlobCall responsibly and legally. Don't use our service for illegal activities, scams, harassment, fraud, mass calling operations, or caller ID manipulation.
In addition, GlobCall strictly prohibits the use of its platform for unsolicited outbound communications, cold calling, telemarketing, lead generation, multi-calling (simultaneous outbound dialing by a single user or agent), and any form of automated or predictive dialing. All outbound communications must be made exclusively to individuals who have given explicit, verifiable, prior opt-in consent to be contacted.
You acknowledge that GlobCall utilizes automated internal monitoring systems to protect its infrastructure. We closely monitor traffic patterns, including but not limited to, Answer-Seizure Ratios (ASR), concurrent call volumes, and Average Length of Call (ALOC). If your account registers dialing patterns characteristic of cold calling, automated dialing, or an unsustainable volume of short-duration calls (averaging under 15 seconds), your account will trigger an immediate system freeze.
If we find misuse or a violation of these traffic metrics, we'll suspend or permanently terminate the account immediately without prior notice, delete all associated phone numbers, and forfeit any remaining credits.
You're responsible for your use of the service and your call content. We don't monitor calls and aren't liable for your use of the service. You represent and warrant that your use of the service complies with all regional telecom regulations, including but not limited to the Telephone Consumer Protection Act (TCPA) and Telemarketing Sales Rules (TSR).
4. Credits, Billing, and Phone Numbers
Calls are charged based on our published rates. You'll need to purchase credits in advance to make calls. We may update our rates with notice. Credits are non-refundable unless required by law.
Phone numbers provisioned through GlobCall are assigned to your account on a conditional basis and remain subject to our administrative control. Upon account suspension or termination for any violation of these Terms, all assigned phone numbers will be immediately deactivated and released. GlobCall is under no obligation to maintain, transfer, or port any numbers following termination.
5. Upstream Provider Compliance
Your use of GlobCall is strictly conditioned upon your compliance with the policies, guidelines, and acceptable use restrictions of our upstream telecommunications networks, underlying carriers, and infrastructure providers. Any activity on your account that causes GlobCall to receive a carrier violation notice, spam complaint, or upstream compliance penalty will result in the immediate and permanent termination of your account.
6. Call Recording
Call recording is an optional feature. If you use it, you're responsible for complying with all recording laws in your area, including getting consent from everyone on the call. We're not liable for your compliance with recording laws.
7. Call Quality and Availability
We work to provide high-quality service, but call quality depends on factors like your internet connection. We don't guarantee uninterrupted service and aren't liable for service interruptions or quality issues beyond our control.
8. Emergency Calls
GlobCall is not a replacement for traditional phone service and should not be used for emergency calls. We cannot guarantee access to emergency services. Please use a traditional phone line for emergencies.
9. Privacy
We collect call metadata for billing, fraud prevention, compliance enforcement, and service improvement. Call content isn't recorded unless you enable the recording feature. Your use of our service is governed by our Privacy Policy.
10. Refunds and Forfeiture
Credits used for completed calls aren't refundable. Accounts suspended or terminated for violations of these Terms, including the prohibition on cold calling and high-volume dialing, are entirely ineligible for refunds. Upon termination for a terms violation, all remaining balances, prepaid credits, and active phone numbers are strictly forfeited as liquidated damages to offset platform administrative and risk mitigation costs. If a call fails due to our technical issues, we'll issue replacement credits, just let us know.
11. Indemnification
You agree to indemnify, defend, and hold harmless GlobCall, its affiliates, directors, officers, employees, underlying carriers, and upstream telecommunications providers from and against any and all claims, actions, demands, liabilities, losses, damages, judgments, settlements, costs, and expenses (including reasonable attorneys' fees and regulatory fines) arising out of or relating to: (a) your violation of any law, statute, or regulation (including the TCPA); (b) your violation of these Terms; or (c) the content or nature of the voice calls initiated through your account.
12. Limitation of Liability
We're not liable for indirect, incidental, or consequential damages (including, without limitation, loss of profits, loss of data, or business interruption) from your use of the service. Our total liability is limited to the amount you paid us in the past 12 months or $100, whichever is less.
13. Updates to Terms
We may update these terms from time to time. You'll be notified of changes via email or via a prominent notice displayed upon logging into the platform. Continued use of GlobCall after such updates constitutes your binding acceptance of the revised Terms.
14. Governing Law and Dispute Resolution
These Terms and Conditions are governed by the laws of Singapore. Any dispute arising out of or in connection with these Terms, including any question regarding its existence, validity, or termination, shall be referred to and finally resolved by arbitration administered by the Singapore International Arbitration Centre (SIAC) in accordance with the Arbitration Rules of the Singapore International Arbitration Centre for the time being in force, which rules are deemed to be incorporated by reference in this clause. The seat of the arbitration shall be Singapore. The language of the arbitration shall be English.
